Delta 8 THC is legal or federally regulated for recreational use in 31 states, illegal in all forms in 14 states, has legal status uncertain in three states, and is controlled in the same as recreational cannabis in 2 states.
Delta 8 THC is legal, while Delta 9 is illegal because of the federal 2018 Farm Bill, ratified by the US Congress. Basically, it states that any cannabis with lower than 0.3% Delta 9 THC is considered hemp and is not illegal.
Delta 8 THC has no Delta 9 THC, hence its legality. Although, more states are considering outright outlawing Delta 8 to make its use more on par with Delta 9 THC.
Is Delta 8 Different From CBD?
Yes. Although both Delta 8 THC and CBD are derived from the cannabis flower, Delta 8 contains the THC compounds that give users the psychoactive effects it’s known for. CBD doesn’t contain THC, although people still use it for physical ailments and mental relief.
